1. Agreement to Terms

Welcome to star (the "Service"). These Terms of Use (these "Terms") constitute a legally binding agreement between you ("user" or "you") and Love & Fury Inc. ("Company," "we," "us," or "our"), a Delaware C Corporation. By accessing or using our Service (including our website, mobile application, or related services), you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Service Description

star is a freemium service that provides AI-powered photo capabilities, allowing users to virtually try on clothing items or otherwise manipulate images through AI. The Service is available worldwide with no geographic restrictions.

3. Subscriptions and Payments

Subscription Options

We offer Weekly, Monthly, and Annual subscription plans.

Pricing

Subscription prices may vary based on the time of your subscription. The price applicable to your chosen subscription will be presented at checkout.

Auto-Renewal

Your subscription automatically renews at the end of the applicable subscription period unless you cancel it through your Apple App Store settings before the current period ends.

No Refunds

All subscription payments are non-refundable.

Cancellation

You may cancel your subscription at any time through your Apple App Store settings. Upon cancellation, you will retain access to any paid features until the end of the current billing cycle.

4. User Conduct

You agree to use the Service in accordance with these Terms and all applicable laws and regulations. Specifically, you agree that you:

Will Not Violate Privacy or Consent

Will obtain all necessary permissions before uploading or manipulating images of other individuals. You shall not use the Service to create, upload, or distribute images of others without their knowledge or consent.

Will Provide Accurate Information

Will provide accurate and complete information when creating an account, and promptly update such information if it changes.

Are Responsible for Content

Are solely responsible for all content (including text, images, and other materials) that you upload, generate, or share through the Service.

Will Comply with Laws

Will not use the Service in any manner that violates any applicable local, state, national, or international law, regulation, or treaty.

5. Prohibited Uses

You agree not to use the Service in a manner that:

Violates the Rights of Others

Infringes upon or violates any copyright, trademark, privacy, publicity, or other proprietary right.

Contains or Promotes Explicit Content

Generates or distributes NSFW, pornographic, sexually explicit, or otherwise inappropriate content intended to harass, exploit, or shock, unless specifically allowed in the context of creative expression and in full compliance with the law. The Company reserves the right to restrict any form of explicit content at its sole discretion.

Promotes Violence or Hatred

Contains material that encourages violence, hatred, racism, or discrimination against any individual or group.

Involves Non-Consensual Imagery

Involves the creation, alteration, or distribution of images of individuals without their explicit, informed consent (e.g., "deepfakes," unauthorized intimate images).

Facilitates Illegal Activities

Contains malware, spyware, viruses, or any code that could disrupt, damage, or limit the functionality of the Service or any user's device, or otherwise contravenes any applicable law.

6. Data Collection and Privacy

Data Collection

• We collect and process user-generated content (including images and other data you upload) solely for the purpose of operating, maintaining, and improving the Service.
• We employ automated systems to detect content that may violate these Terms. If your content is flagged, we reserve the right to manually review such content to determine whether it violates these Terms or applicable law.

Data Retention

• We will retain your data for up to one (1) year from the date of submission, unless a longer retention period is required by law or is necessary for legitimate business purposes.
• If content is flagged for review or is under investigation, we may retain it for the duration of the review process or any related investigation. Afterward, we will delete or anonymize the data unless legally required to keep it longer.

Use of Data for AI Training and Improvement

By uploading or creating content on the Service, you grant Love & Fury Inc. a non-exclusive, worldwide, royalty-free license to use your content for training and refining our AI models and improving our services. This may include analyzing, storing, and reproducing your content for algorithmic development.

Opt-Out: If you do not wish your data to be used for AI training and improvement, you may opt out at any time by emailing us at withlovefury@gmail.com. Upon receiving your request, we will cease using your future content for AI training. However, please note that any content already used in anonymized or aggregate form may not be fully removable from existing trained models.

Third-Party Sharing

• We may share your data with AI vendor providers or other service providers strictly as necessary to perform or improve our services.
• We will not sell your data or share it with third parties for marketing purposes.

User Consent

• By using the Service, you explicitly consent to our collection, retention, and review of your content for content moderation and to ensure compliance with these Terms.
• You also consent to our use of your content for AI training and service improvement unless you opt out as described above.

Data Deletion Requests

• If you wish to request deletion of your data, please contact us at withlovefury@gmail.com. We will respond to such requests within a reasonable timeframe.
• Note that certain data may need to be retained for legitimate business or legal reasons, especially if the content is under investigation, or as part of compliance with these Terms.

7. Termination

We reserve the right, at our sole discretion, to suspend or terminate your account and/or access to the Service at any time for any reason, including but not limited to:

• Violation of these Terms
• Suspected or actual illegal activity
• Creation, upload, or distribution of Prohibited Content
• Attempts to bypass our content moderation systems

You agree that we shall not be liable to you or any third party for any termination or suspension of your access to the Service.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. You agree to submit to the personal jurisdiction of the state and federal courts located within Delaware for any actions arising out of these Terms or your use of the Service.

9. Changes to Terms

We reserve the right to modify these Terms at any time. In the event of any material changes, we will notify you through the Service (e.g., a pop-up notification in the app) or by email. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must cease using the Service.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, the Company disclaims all warranties, express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranties arising out of course of dealing or usage of trade
• Any warranty that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components

11. Limitation of Liability

To the maximum extent permitted by law:

• In no event shall the Company or its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, or goodwill.
• The Company's total liability for any claim arising out of or relating to these Terms or your use of the Service shall not exceed the amount you have paid to us (if any) in the twelve (12) months immediately preceding the event giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its affiliates, and each of their respective officers, directors, employees, and agents from any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any law or the rights of any third party
• Any content you create, upload, or distribute through the Service
